By accessing and using this mobile application ("App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Our App provides a nutrition tracking and health management platform that includes:

  • AI-powered food recognition and nutritional analysis
  • Personalized nutrition tracking and health management
  • Exercise tracking and calorie burn monitoring
  • AI-powered nutritional suggestions and insights
  • HealthKit and Health Connect integration and data synchronization

3. User Accounts and Responsibilities

Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Be at least 13 years of age, or have parental consent
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Promptly notify us of any unauthorized use of your account

4. User Content Rights

Content Ownership

You retain all ownership rights in the content you create, including photos and comments. We do not claim ownership of your user-generated content.

Content Standards

All user content must:

  • Be lawful and not infringe any third party's rights
  • Be accurate and not contain misleading information
  • Not contain harmful or dangerous advice
  • Respect community standards and cultural differences
  • Not contain offensive, abusive, or discriminatory content

5. AI Services and Health Disclaimers

Not a Medical Organization

Eatmoji is not a medical organization. The content, including text, graphics, images, and other material contained on the App ("Content"), is for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

AI Accuracy Disclaimer

Our services utilize Artificial Intelligence (AI) to provide nutritional estimates and food identification. While we strive for accuracy, AI-generated data are estimates and may contain errors. You should not rely on this information as a precise measurement for medical purposes (e.g., insulin dosage, strict allergen avoidance).

Medical Disclaimer

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

You explicitly acknowledge and agree that:

  • We do not provide medical advice, diagnosis, or treatment.
  • Use of the App does not create a doctor-patient relationship.
  • You are solely responsible for your health and dietary decisions.
  • You should consult a doctor before starting any new diet or exercise program.
  • In case of a medical emergency, call your local emergency services immediately.

6. Prohibited Uses

You may not use our service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate

  • To reverse engineer, decompile, or disassemble the App

7. Subscription and Payment Terms

Free and Premium Features

We offer both free basic features and premium subscription features. Premium features may include advanced nutritional analysis, expanded AI insights, and priority customer support.

Payment Processing

Subscription fees are processed through the Apple App Store or Google Play Store according to their respective terms of use.

Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription through your device's account settings.

8. Intellectual Property Rights

Our Rights

The App, including its design, code, AI algorithms, and trademarks, are owned by us and protected by intellectual property laws. You are granted a limited license to use the App for personal, non-commercial purposes only.

Your Rights

You retain all rights to the content you create. We only obtain the limited rights necessary to operate our services as outlined in these terms.

9. Third-Party Integrations

Health App Integration

Our App integrates with Apple HealthKit and Google Health Connect. This integration is subject to their respective terms of use. We only access health data with your explicit permission.

Specific Terms for Google Health Connect

You explicitly agree that our access to and use of data from Google Health Connect adheres to the Google Health Connect Permissions Policy, including the Limited Use requirements.

Other Services

Our App may integrate with other third-party services for payments, cloud storage, or analytics. These services have their own terms of use and privacy policies.

10. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding:

  • The continuous availability of the service
  • The accuracy or completeness of the content
  • The fitness for any particular purpose
  • The absence of errors or interruptions

11. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or use
  • Business interruption
  • Personal injury or property damage
  • Any damages arising from use or inability to use the service

12. Indemnification

You agree to defend, indemnify, and hold harmless our company, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.

13. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service.

14. Governing Law

These Terms shall be interpreted and governed by the laws of Taiwan, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Taiwan.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

16. Severability

If any provision of these Terms is deemed invalid, unlawful, void, or unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.
